Unless otherwise provided herein, any grant of rights from Photographer to Client is limited to the private, personal use of photographic material purchased by Client. All photographs are released to the client for non-resale use. No commercial reuse of the images is permitted without express written permission by Leah Katherine Photography. Unless negotiated in a separate instrument, No photo purchased may be used for any kind of contest without permission of photographer. (TYPE YOUR NAME BELOW)

Images from this session may be used as advertising, display, or any purpose thought proper by Photographer without additional compensation to Client. All images shared on social media are to be resized version clearly showing ‘Leah Katherine Photography watermark'. Watermark is not to be cropped or removed; this will protect both parties from unauthorized web download of images posted online. All useable Digital Files are included in the Family All Inclusive Special. A La Carte prints and products are also offered. Large format prints should be ordered direct from Photographer for best results. Client hereby expressly consents to the jurisdiction of the Federal District Courts under the Copyright Act of 1976, as amended. No images may be cropped, edited or tampered with in any way. Cancellations must be made 72 hrs in advance of your session date. All cancellations made within 72 hrs forfeits your retainer. When rescheduling with more than 72 hours notice, the non-refundable retainer you paid may be applied toward your rescheduled session date. If the session is not rebooked within 6 months, the retainer is forfeited. If you cancel or reschedule less than 72 hours before the session time, or do not appear for the session, a Late Cancellation Fee will be imposed. The Late Cancellation Fee is an amount equal to the retainer for that session. Therefore, the retainer is forfeited and you must pay a new retainer in order to re-schedule a new session. Many ask, what will happen if the weather is bad on the day of our photo session? It is up to the discretion of myself, the photographer, if the appointment should be cancelled due to weather. Bad weather, consist of all day rain or rain during the time of the photo session, for these instances, we can reschedule without forfeiting your retainer. (TYPE YOUR NAME BELOW)

If Photographer cannot perform this Agreement in whole or in part due to a fire or other casualty, or nature or terror, or other cause beyond the control of the parties or due to Photographer's illness or injury, then Leah Katherine Photography will return all fees to the Client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. Photographer is not responsible for non satisfactory of images due to clothing choices of siblings / parents. Leah Katherine Photography is always available to help with clothing choices and recommendations. (TYPE NAME BELOW)

Model Release: I, the undersigned, do hereby consent and agree that Leah Katherine has the right to take photographs, videotape, or digital recordings of me/my children/my family members and to use these in any and all media, now or hereafter known. I further consent that my name and identity may be revealed therein or by descriptive text or commentary. I do hereby release to Leah Katherine all rights to exhibit this work in print and electronic form publicly or privately. I waive any rights, claims, or interest I may have to control the use of my identity or likeness in whatever media used. I understand that there will be no financial or other remuneration for recording me, either for initial or subsequent transmission or playback. I understand that Leah Katherine is not responsible for any expense or liability incurred as a result of my participation in this recording, including medical expenses due to any sickness or injury incurred as a result. Moreover, I am the parent or guardian of the minor child named below and I have the legal authority to execute this release on behalf of the child. In consideration of the child’s engagement as a model and for other valuable consideration received Photographer and Photographer’s heirs, legal representatives, and assigns the irrevocable, perpetual, and unrestricted right to take and use photographs of the child named below taken by the Photographer in all forms, media and manners, in conjunction with the child’s or a fictitious name, for advertising, trade, promotion, exhibition, or any other lawful purposes. The purchase of the original files releases Leah Katherine Photography from any liability due to loss or damage of the images, and also releases Leah Katherine Photography from any obligation to maintain copies of any digital file, image, or photograph. Purchase of digital files will include the right for the Client to print, copy, and share photographs online. Purchase of digital files does not authorize the Client to edit the photographs in any way, except cropping in preparation to print, and does not release ownership of the photographs to the purchaser. The Client is not permitted to sell or submit digital files to contests of any kind. Digital files are sized to be printed 8*10. Large format prints should be ordered direct from photographer. Leah Katherine Photography recommends www.mpix.com for high quality consumer-level prints. When uploading photographs online, the Client is asked to link to the Photographer’s website, www.leahkatherinephotography.com.
