All Images and rights therein, including copyright, remain the sole and exclusive property of Leah Katherine Photography. Unless otherwise provided herein, any grant of rights from Photographer to Client is limited to the private, personal use of photographic material purchased by Client. All photographs are released to the client for non-resale use. No commercial reuse of the images is permitted without express written permission by Leah Katherine Photography. Unless negotiated in a separate instrument, No photo purchased may be used for any kind of contest without permission of photographer. (TYPE YOUR NAME BELOW)

Images from this session may be used as advertising, display, or any purpose thought proper by Photographer without additional compensation to Client. All images shared on social media are to be resized version clearly showing ‘Leah Katherine Photography watermark'. Watermark is not to be cropped or removed; this will protect both parties from unauthorized web download of images posted online. All Digital Files are purchased separate from the session fee. Digital and Product packages start at $495. A La Carte items are also offered. Large format prints should be ordered direct from Photographer for best results. Client hereby expressly consents to the jurisdiction of the Federal District Courts under the Copyright Act of 1976, as amended. No images may be cropped, edited or tampered with in any way. Cancellations must be made 72 hrs in advance of your session date. All cancellations made within 72 hrs forfeits your retainer. When rescheduling with more than 72 hours notice, the non-refundable retainer you paid may be applied toward your rescheduled session date. If the session is not rebooked within 6 months, the retainer is forfeited. If you cancel or reschedule less than 72 hours before the session time, or do not appear for the session, a Late Cancellation Fee will be imposed. The Late Cancellation Fee is an amount equal to the retainer for that session. Therefore, the retainer is forfeited and you must pay a new retainer in order to re-schedule a new session. Many ask, what will happen if the weather is bad on the day of our photo session? It is up to the discretion of myself, the photographer, if the appointment should be cancelled due to weather. Bad weather, consist of all day rain or rain during the time of the photo session, for these instances, we can reschedule without forfeiting your retainer. (TYPE YOUR NAME BELOW)

If Photographer cannot perform this Agreement in whole or in part due to a fire or other casualty, or nature or terror, or other cause beyond the control of the parties or due to Photographer's illness or injury, then Leah Katherine Photography will return all fees to the Client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. The client(s) agree(s) to positive cooperation and communication for the best possible result within the definition of this agreement. Leah Katherine Photography. Photography is not responsible for key individuals’ failure to be present or to cooperate during photography sessions, or for missed images due to details not revealed to Leah Katherine Photography. No Guaranteed Results- Photographer will make a good faith effort to achieve Client’s desired results. However, young children are inherently more challenging to photograph and may experience behavioral or attention-related problems during the session. Client acknowledges that Photographer cannot and will not guarantee any particular results. If Client’s child does not or cannot cooperate during the session, Client is still responsible for full payment under this Agreement due to time allotted for the session. Please note Leah Katherine Photography has vast experience photographing children and will make all efforts to create cooperative experience with the young clients. (TYPE YOUR NAME BELOW)

Photographer is not responsible for non satisfactory of images due to clothing choices of siblings / parents. Leah Katherine Photography is always available to help with clothing choices and recommendations. (TYPE NAME BELOW)

Model Release: I, the undersigned, do hereby consent and agree that Leah Katherine has the right to take photographs, videotape, or digital recordings of me/my children/my family members. now or hereafter known. I understand that there will be no financial or other remuneration for recording me, either for initial or subsequent transmission or playback. I understand that Leah Katherine is not responsible for any expense or liability incurred as a result of my participation in this recording, including medical expenses due to any sickness or injury incurred as a result. Moreover, I am the parent or guardian of the minor child named below and I have the legal authority to execute this release on behalf of the child. In consideration of the child’s engagement as a model and for other valuable consideration received Photographer and Photographer’s heirs, legal representatives, and assigns the irrevocable, perpetual, and unrestricted right to take and use photographs of the child named below taken by the Photographer in all forms, media and manners, in conjunction with the child’s or a fictitious name. The purchase of the original files releases Leah Katherine Photography from any liability due to loss or damage of the images, and also releases Leah Katherine Photography from any obligation to maintain copies of any digital file, image, or photograph. Purchase of digital files will include the right for the Client to print, copy, and share photographs online. Purchase of digital files does not authorize the Client to edit the photographs in any way, except cropping in preparation to print, and does not release ownership of the photographs to the purchaser. The Client is not permitted to sell or submit digital files to contests of any kind. Digital files are sized to be printed 8*10. Large format prints should be ordered direct from photographer. Leah Katherine Photography recommends www.mpix.com for high quality consumer-level prints. When uploading photographs online, the Client is asked to link to the Photographer’s website, www.leahkatherinephotography.com. This release shall be binding upon me and my heirs, legal representatives, and assigns (TYPE YOUR NAME BELOW)

It is the Client's responsibility to inform the Photographer of baby's arrival. The sooner the Client notifies the Photographer, the more available session dates will be open for the Client to pick from. (TYPE NAME BELOW)
